Prescription for Lena - 2008 Breeding Agreement Live Cover Only Double S Ranch 979-849-5913 Home, 979-215-4550 Cell 114 River Road, CR. 31 Angleton, Texas 77515 This agreement is made on _______________________________, by and between Jeremey or Alisha Stark, ( Stallion Owner or Agent ), and ______________________________ (Mare Owner). 1. Consideration: In consideration of _____________dollars ($_____________), Stallion Owner hereby agrees to breed the stallion ______________________________ registration number__________ to Mare Owner’s mare ____________________ registration number___________ 2. Payment: Mare Owner hereby agrees to pay said breeding charge of $___350.00____(includes $50.00 non refundable booking fee)______ On the dates indicated below: Date Mare in: ________________ Paid $ ___________________ Date Mare out: ________________ Paid $ ___________________ 3. Live Foal Guarantee & Return Breeding Privileges: STALLION SERVICE FEES ARE NON-REFUNDABLE, HOWEVER: In the event that Mare Owner’s mare does not take and become in foal, or miscarries, Alisha Stark, (Agent ) for Stallion Owner (Jeremey Stark), must be notified in writing by a veterinarian within one week following the birth that the mare produced a non viable foal, or if after mare should absorb or abort. Stallion Owner agrees to breed that mare again for $ 50.00, additional booking fee and consideration at any time before 18 months of the last breeding date of said mare. “Live Foal” means able to stand and nurse for at least 24 hours after birth. If the mare owner elects not to breed same mare back to Prescription for Lena in the current season, they may elect to breed the following season and if said mare becomes unable or unfit to breed, mare owner may elect to substitute said mare for another upon approval of Stallion Owner. Stallion Owner shall have no further liability for servicing said mare. If for any reason that Prescription for Lena becomes unfit for breeding service, be sold, or die, Mare Owners have an option to breed their mare to any other APHA stallion owned by Jeremey Stark or Double S Ranch. Mare Care charges will be charged for all re-breeds. 4. Veterinarian Certificates: Mare Owner warrants that said mare is free from disease or infection that could be transmitted to said stallion, and agrees to pay for and provide, upon arrival, a veterinarian health certificate, showing freedom from disease or infection. Stallion Owner warrants that said stallion is free from disease or infection that could be transmitted to said mare, and agrees to pay for and provide a veterinarian health certificate, showing such freedom from disease or infection. Mare Owner will also produce a current, negative EIA (Coggins certificate) dated within 3 months prior to arriving at Double S Ranch. 5. Veterinarian and Farrier Care: Stallion Owner agrees to use reasonable care and caution for said mare while in his/her possession or control, pursuant to this Agreement, and is authorized to obtain any necessary reasonable veterinarian or farrier care as required, but only after taking steps to contact Mare Owner without success. 6. Risk of Loss and Hold Harmless: Mare Owner agrees to assume the risk of loss due to injury, sickness, or death of said mare for any reason. Mare owner agrees to indemnify and hold Stallion owner harmless for any loss or injury due to acts of said mare while on premises or under control of Stallion Owner. To protect against said loss or injury, Stallion Owner strongly suggests that Mare Owner at their own expense, secure liability insurance for personal injury and/or property damage and to provide a certificate of insurance having Stallion Owner named as additional Insured. Mares that are not halter broken or cannot be hobbled or are unruly WILL NOT BE ACCEPTED. Booking fee of $50.00 will not be refunded. Pre-paid breeding fees will not be refunded, but a substitute mare may be approved by Stallion owner, or breeding fee may be sold to another approved mare owner, as long as Stallion owner is notified in writing and the breeding is approved by Stallion owner. Mare care will accrue at $10.00 a day and their will be No Refund of mare care. 7. Registration: Stallion Owner agrees to execute all necessary documents of the registration of the offspring of the breeding after all monetary or other obligations are met. 8. Care and Feeding of Mare: In addition to the above breeding and booking charge, Mare Owner agrees to pay the following: $10.00 (ten dollars) per day, per mare, Mare care will be charged. No negotiations on whether the mare is stalled or pastured. Mare care will start accruing in full on the day of arrival, and continue through the day of departure. Termination: Either Party may terminate this Agreement for failure of other party to meet any material or monetary terms of this Agreement. In the case of any default by one party, the wronged party shall have the right to recover reasonable attorney’s fees and all court costs incurred as a result of said default. This agreement is governed and shall be construed under the laws of the State of Texas. By signing below both parties agree in full on the content of this contract.
